Welcome to KingCretot Experience. These Terms of Service ("Terms") govern your access to and use of www.kingcretot.com (the "Website") and any educational services, consultations, courses, tutoring sessions, test preparation, or other offerings provided by KingCretot Experience, LLC ("KCE," "we," "us," or "our"). By accessing the Website or enrolling in any KCE service, you agree to be bound by these Terms. If you do not agree, please do not use our Website or services.

These Terms work together with our Privacy Policy, which is incorporated here by reference.

1. Description of Services

KCE is a boutique virtual education center offering one-on-one and small-group instructional services. Our current programs include French language instruction, English language instruction, K–12 academic tutoring, homeschool tutoring and enrichment, SAT and other standardized test preparation, and scholarship-funded tutoring through the Florida Step Up for Students program. Services are delivered primarily online via video conferencing. In-person services may be available in select locations at the rates published on our Website.

We may add, modify, or discontinue services at any time. We will provide reasonable notice of material changes affecting enrolled clients.

2. Eligibility

You must be at least 18 years old to enter into these Terms, create an account, schedule services, or make payments. By using our services, you represent and warrant that you are at least 18 years old, that you have the legal capacity to enter into binding contracts, and that the information you provide is true, accurate, and complete.

Services may be provided to minors only when a parent or legal guardian agrees to these Terms on the minor's behalf, completes enrollment, makes payment, and supervises the minor's participation as appropriate. The parent or guardian remains responsible for all activity associated with the minor's services and account.

3. Bookings, Lessons, and Payments

Free Consultations

We offer free 30-minute consultations to help families determine whether KCE is the right fit. Consultations are scheduled through our Calendly links and held via Zoom. Free consultations are not a guarantee of enrollment or service availability.

Enrollment and Payment

When you enroll in paid services, you agree to the rates, package terms, and schedule in effect at the time of enrollment, as published on our Website or in the enrollment documents we provide. Payment is required in advance of services unless otherwise agreed in writing.

Payments are processed by third-party payment processors (currently Stripe and PayPal). By providing payment information, you authorize us and our payment processors to charge the applicable amounts. You are responsible for keeping payment information current. We do not store full payment card numbers on our servers.

Package Terms

Multi-session packages are valid for the term stated at the time of purchase (for example, a half-year package is valid for 18 weeks; a full-year package is valid for 36 weeks). Unused sessions do not roll over beyond the package term unless we agree otherwise in writing.

Scheduling and Time Zones

All sessions are scheduled in advance through Calendly or by direct arrangement with your instructor. Session times are confirmed in the time zone you provide at enrollment. You are responsible for joining sessions on time and for ensuring that you have a working internet connection, a suitable device, and a quiet learning environment.

4. Cancellation, Rescheduling, and Refund Policy

Rescheduling and Cancellations by You

• •More than 24 hours before a session: you may reschedule or cancel at no charge. The session credit is preserved.
• •Less than 24 hours before a session: the session is forfeited and counted as completed. We will make reasonable efforts to reschedule when circumstances allow, at our discretion.
• •No-shows: if you do not join within 15 minutes of the scheduled start time without prior notice, the session is forfeited.

Rescheduling and Cancellations by KCE

If KCE must cancel or reschedule a session, we will provide as much notice as possible and offer alternative times. Sessions canceled by KCE are not deducted from your package.

Package Refunds

You may request a refund of unused sessions in a package within 30 days of the package start date. Refunds are calculated by subtracting the per-session rate of any sessions used (at the standalone, non-package rate) and an administrative fee of $25 from the amount paid. Sessions that have been forfeited under the cancellation policy above are treated as used.

Refund requests received more than 30 days after the package start date are reviewed on a case-by-case basis and are not guaranteed.

Step Up Scholarship-Funded Services

Services funded through the Florida Family Empowerment Scholarship for Educational Options (FES-EO) or Unique Abilities (FES-UA) are governed by Step Up for Students program rules. Refunds, if any, are processed in accordance with those rules and are returned to the scholarship account rather than paid to families directly.

5. Step Up for Students Scholarship Terms

KCE is an approved provider of instructional services for families using the Florida Family Empowerment Scholarship through Step Up for Students. Enrollment in scholarship-funded services is contingent on the family's eligibility and the availability of scholarship funds. KCE is responsible for delivering the agreed instructional services; we are not responsible for determining scholarship eligibility, processing scholarship applications, or any decisions made by Step Up for Students or the State of Florida. Families remain solely responsible for compliance with scholarship program requirements.

6. User Conduct

When using our Website or services, you agree to:

• •Treat instructors, staff, and other students with respect and professionalism
• •Use our services only for lawful educational purposes
• •Not record, copy, redistribute, or publicly share lesson sessions, course materials, or instructor content without our prior written permission
• •Not attempt to gain unauthorized access to our systems or interfere with the operation of our services
• •Not use our services to harass, threaten, or harm any person

We reserve the right to suspend or terminate services for any user who violates these standards, with or without refund depending on the circumstances.

7. Intellectual Property

All content on our Website and in our instructional materials — including text, graphics, logos, lesson plans, worksheets, slides, video content, and the KingCretot Experience and KCE names and marks — is the property of KingCretot Experience, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our content solely for your personal educational use in connection with the services you have enrolled in. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, or commercially exploit any of our content without our prior written permission.

You retain ownership of any original work you create during lessons (such as essays, problem sets, or projects). By submitting such work to your instructor, you grant KCE a limited license to use it for the purpose of providing feedback, instruction, and assessment to you.

8. Educational Disclaimers

We are committed to delivering high-quality instruction tailored to each student. However, learning outcomes depend on many factors that are outside our control, including student effort, attendance, prior preparation, and individual circumstances.

KCE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ACADEMIC OUTCOMES, GRADE IMPROVEMENT, TEST SCORE INCREASES, COLLEGE OR PROGRAM ADMISSIONS, SCHOLARSHIP AWARDS, OR OTHER SPECIFIC RESULTS. ANY ESTIMATES, EXAMPLES, OR PAST OUTCOMES DISCUSSED IN MARKETING MATERIALS OR DURING CONSULTATIONS ARE FOR ILLUSTRATIVE PURPOSES ONLY AND ARE NOT GUARANTEES.

Our services are intended to supplement, not replace, formal schooling, professional educational evaluations, or specialized therapies. We do not diagnose learning disabilities and do not provide medical, psychological, or therapeutic services.

9. Disclaimer of Warranties

THE WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KINGCRETOT EXPERIENCE, LLC, ITS OWNERS, OFFICERS, INSTRUCTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE WEBSITE OR SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE WEBSITE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES WILL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO KCE IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless KingCretot Experience, LLC and its owners, officers, instructors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with (a) your violation of these Terms; (b) your use of the Website or services; (c) your violation of any rights of another; or (d) your violation of any applicable law.

12. Termination

We may suspend or terminate your access to our Website or services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use our services ceases immediately. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitations of liability, indemnification, and governing law — will survive.

You may terminate your relationship with KCE at any time by ceasing use of our services and notifying us. Any outstanding balances remain payable, and refunds (if any) are governed by Section 4.

13. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to them or your use of our Website or services are governed by the laws of the State of Florida, without regard to its conflict of laws principles.

Before filing any legal action, you agree to first attempt to resolve any dispute by contacting us in writing at [email protected] and giving us a reasonable opportunity (at least 30 days) to resolve the matter informally.

If informal resolution is unsuccessful, any legal action must be brought exclusively in the state or federal courts located in DeSoto County, Florida, and you consent to the personal jurisdiction of those courts.

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND KCE EACH WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION AGAINST THE OTHER.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. Material changes will be communicated through our Website or, where appropriate, by email. Your continued use of our Website or services after changes take effect constitutes acceptance of the updated Terms.

15. Miscellaneous

These Terms, together with our Privacy Policy and any enrollment documents we provide, constitute the entire agreement between you and KCE regarding the Website and services and supersede all prior agreements on those topics. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms at any time.
